HikerNerd provides informational content only and is NOT a substitute for proper preparation, experience, equipment, and judgment. Always verify conditions with official sources before hiking. By using HikerNerd, you acknowledge these risks and accept full responsibility for your safety.
These Terms of Service ("Terms") govern your use of the HikerNerd website and services (the "Service") operated by HikerNerd LLC ("HikerNerd," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using HikerNerd, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
HikerNerd is a hiking tracking and information platform focused on the New Hampshire 48 4,000-footers. The Service provides:
- Peak and route tracking
- AI-generated trail condition summaries
- Weather information from third-party sources
- Trip planning tools
- Community features including leaderboards and reviews
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Providing accurate information
- Being at least 13 years of age to use the Service
4. Trail Conditions Disclaimer
Trail conditions provided by HikerNerd are generated using artificial intelligence and third-party data sources. This information is for general reference only and should NOT be relied upon for safety-critical decisions.
You acknowledge and agree that:
- Conditions in the White Mountains can change rapidly and without warning
- AI-generated conditions may be inaccurate, incomplete, or outdated
- Trail conditions are informational only, not professional mountaineering advice
- You must always verify conditions with official sources before hiking, including:
- U.S. Forest Service (USFS)
- Appalachian Mountain Club (AMC)
- Mount Washington Observatory
- Mount Washington Avalanche Center
- National Weather Service
- HikerNerd is not a substitute for proper preparation, equipment, experience, and judgment
5. Assumption of Risk
HIKING, ESPECIALLY IN THE WHITE MOUNTAINS OF NEW HAMPSHIRE, INVOLVES INHERENT AND SIGNIFICANT RISKS INCLUDING BUT NOT LIMITED TO: SEVERE WEATHER, HYPOTHERMIA, FROSTBITE, FALLS, AVALANCHE, WILDLIFE ENCOUNTERS, GETTING LOST, SERIOUS INJURY, AND DEATH.
By using HikerNerd, you expressly acknowledge and assume all risks associated with hiking and outdoor activities. You agree that:
- You are solely responsible for your own safety and well-being
- You will make your own independent decisions about when and how to hike
- You understand that above-treeline conditions can be life-threatening
- You will carry appropriate gear and know how to use it
- You will turn back if conditions become dangerous
- In an emergency, you will call 911, NOT HikerNerd
6. Disclaimer of Warranties
THE SERVICE AND ALL CONTENT, INCLUDING TRAIL CONDITIONS, ROUTES, WEATHER DATA, AND ANY OTHER INFORMATION, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We specifically disclaim all warranties including:
- Accuracy, completeness, or reliability of any information
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free service
- Security of data transmission
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIKERNERD LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury or death
- Property damage
- Loss of data
- Loss of profits or revenue
- Any damages arising from your use of or inability to use the Service
- Any damages arising from reliance on information provided through the Service
In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
8. User-Generated Content
You may submit content including routes, reviews, photos, and trip reports. By submitting content, you:
- Grant us a non-exclusive, royalty-free license to use, display, and distribute your content
- Represent that you own or have rights to the content
- Agree not to submit false, misleading, or harmful content
- Understand that we may remove content at our discretion
We do not guarantee the accuracy of user-submitted content and are not liable for any damages resulting from reliance on such content.
9. Subscription Terms
Paid subscriptions (Trailblazer) are billed monthly or annually through our payment processor. You agree that:
- Subscriptions auto-renew unless cancelled
- You can cancel at any time; access continues until the end of your billing period
- We offer a 14-day money-back guarantee for new subscriptions
- Prices may change with notice; existing subscribers keep their rate
- Refunds beyond the guarantee period are at our discretion
10. Intellectual Property
The HikerNerd name, logo, and all original content are owned by HikerNerd LLC. You may not use our trademarks without permission. Third-party data (weather, maps) remains the property of their respective owners.
11. Prohibited Conduct
You agree not to:
- Violate any laws or regulations
- Submit false ascent records or misleading information
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Service
- Use automated systems to scrape or access the Service
- Interfere with the proper operation of the Service
12. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.
13. Indemnification
You agree to indemnify, defend, and hold harmless HikerNerd LLC from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another.
14. Governing Law
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New Hampshire.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
